1. Do I need a lawyer?

In Germany, legal representation is mandatory at the regional court level and above. Below that level, you may represent yourself. Your attorney acts as your representative. They assess the legal situation, ensure compliance with procedural requirements and deadlines, draft legal briefs, and attend court hearings on your behalf. This helps you gain much-needed perspective on contentious issues and allows you to leverage your attorney's advocacy skills. With their guidance, you can navigate your way to a successful outcome.

2. How much does it cost to hire a lawyer?

Attorney fees are generally based on our fee agreement or the statutory fee schedule. The value of your case is used as the basis for calculation. However, not every initial contact incurs a fee! During a brief introductory consultation, we will outline your situation without providing a binding assessment or legal advice.

In certain cases, some legal expense insurers cover all or part of the legal fees. Feel free to call your insurance company in advance and ask about cost coverage.

4. What is the "amount in dispute"?

The amount in dispute is determined by the value of the asset that is the subject of the dispute.

For this purpose, the value stated by the client is initially decisive. For example, if you expect a payment of EUR 30,000, this is the amount in dispute — regardless of whether this amount can actually be recovered later. If the claim increases during the course of the proceedings, this value is decisive.

This applies equally if you retain us to defend against the claim. In this case, the fee is based on the amount claimed by the opposing party — regardless of whether the claim is valid.

Statutory fees are determined based on the amount in dispute, as the lawyer's liability risk increases as the amount in dispute rises.

3. Do I need to pay for a 'quick question'?

We'll provide you with a brief, no-obligation assessment of whether it's worth consulting a lawyer at all. This service is free of charge. If you have questions regarding the specifics of your matter, we'll only answer them as part of a paid consultation. We'll discuss the costs with you during our conversation.

Entrepreneurs and business owners in particular often have quick legal questions or need a brief assessment. In these (and other) cases, we offer hourly-rate fee agreements.

This way, you know in advance what costs to expect and can plan accordingly.

4. How do I sue someone in Germany?

You believe you have a claim that you wish to pursue in court. To do so, please contact the Albrecht Law Firm. During our initial consultation, we will assess your legal situation. As a rule, the opposing party is then requested to comply with your demands. If this proves unsuccessful, your attorney will draft the complaint based on the information you provide and file it with the appropriate court. During the hearing, a settlement may be reached, or a judgment may be issued.

5. Does my insurance cover the fees?

This depends on the terms of your specific insurance policy. If you retain the Albrecht law firm, the coverage inquiry and correspondence with your legal expenses insurer are free of charge for you. You can also call your insurer directly in advance to find out whether your legal expenses insurance covers the costs of the initial consultation or the retainer. Be sure to ask about any deductible as well! Legal and court fees are generally covered, but not every risk is covered in every contract. We can address any questions about billing arrangements during the initial consultation.

6. How do I spot a good lawyer?

Your trust in your lawyer is key: a good lawyer comes across as approachable and competent. They provide you with comprehensive advice on both the opportunities and the risks involved. They take their time during consultations, keep to agreed-upon deadlines, and keep you informed about your case. Take the time to get to know your lawyer and form your own impression: your case may last for years! Make sure the firm is easy to reach: can you speak directly with your attorney, or are you constantly being put off by the receptionist? Be sure to discuss costs with your attorney as well. A good attorney is transparent and won't surprise you with unexpected bills. Ultimately, the fit has to be personal: you should feel comfortable with your attorney.
